Propaganda sells SPAK's victory as a defeat

The media, which serves as a tool of power and a sycophant of a mayor arrested on 13 charges for several serious criminal offenses, continues its attack on the Special Prosecution Office.

In an article published on the portal of a "smelly journalist" about the millions he has received from the government, it is stated that "the Constitutional Court has rejected SPAK's arbitrary practice against Onejda Ymeraj."

But, in fact, the truth is quite different. What the propaganda seeks to sell as a loss for SPAK is actually a victory.

Why?

In its decision, the Constitutional Court legitimized the seizure of the phone, rejecting what the propaganda says.

It is written in black and white that the Constitutional Court has ruled in their favor and says they can be taken for criminal investigation, but then referred to the court and private data should not be violated.

"Exceptionally, in emergency conditions, correspondence may also be seized by the Judicial Police, which in any case must be subject to judicial control," states, among other things, the decision of the Constitutional Court regarding the case of citizen OY.

Although there are many other cases where phone seizures have been made with court decisions, even when they have been made without court decisions, as in this specific case, SPAK has been given the right to say that you can seize the phone and for the purposes of a criminal investigation, you can obtain this data, but you must not violate private data.

So, the Constitutional Court has ruled in favor of SPAK, it is the opposite of what the propaganda says, it is a victory for SPAK for investigative actions.

The phone is taken by surprise to find information. There are other cases where phones have been taken and replaced.

So, taking the phone is not an investigative action that is done whether the propaganda likes it or not, it is an investigative action to secure evidence, and the moment evidence is secured, the Constitutional Court says very clearly that you can take it, secure the evidence, and then take it to court. It's that simple.

It is a victory for SPAK, but propaganda will raise a smokescreen as if SPAK has lost in the Constitutional Court, but the truth is the opposite, in fact, it has won./ CNA
