The Constitutional Court a day ago accepted the request of President Bajram Begaj, making a decision to determine all the mandates of existing members.

Regarding this decision, DP leader Sali Berisha reacted today by attacking the Constitutional Court, saying that it has violated its law.

"Yesterday, the most extreme level of abuse, misadministration, misuse of the Constitution, the constitutional institutions of the country was recorded, and this was done with a decision that will be recorded on the walls of time, the most shameful decision in the jurisprudence of this country.

It will be recorded as the most scandalous act of the Sorosian monster, the Sorosian justice reform. The Constitutional Court decided to overturn its law. The Constitutional Court decided to overturn the official opinions of the Venice Commission.

The definition of the Constitution in Article 125, point 6, that the composition of the Constitutional Court is renewed every three years by one third according to the procedure established by law, has been transcribed, embodied in the organic law of the Constitutional Court, Article 86, point 4, in which the sanctions: The renewal of the judges of the Constitutional Court until 2022 will be carried out according to the scheme provided below.

So, the legislator has declared the renewal by one third, as provided for in the Constitution, to be right until 2022.

Anyone who had an objection to this definition of the law, which is an organic law, of the Constitutional Court, had the right to address the parliament, which could amend the law.

But Sadushi did not do this either, once again, taken hostage through the vetting, which in violation of the Constitution is not made public, the Supreme Court keeps it in a secret drawer. We will certainly make it public.

But the Constitutional Court also had the right to ask parliament not for an opinion on the candidacies, because there is no parliamentary opinion on this, as it did, but it had the right to ask parliament as a legislator to determine its position on the legislation, which as long as it is in force, is in effect.

Sonila Bejtja began her term in 2020. It should end in 2028.

The Venice Commission says that constitutional judges should serve a full 9-year term, even if they were elected later or took over the mandate of someone who left.

According to the law of the Constitutional Court, the Venice opinion and the Constitution itself, her mandate cannot be interrupted. The Constitution states that her mandate begins from the moment the judge takes the oath.

This is zero tolerance for dissent, for the minority. Ms. Bejtja was an independent voice that respected the fundamental principle of a system. Here, she is not a political advocate but for the constitutional order. With the composition of the Constitutional Court with people taken hostage, there is no doubt that Edi Rama controls everything.
