Veliaj's dismissal/ Council of Ministers' submissions to the Criminal

The submissions of the Council of Ministers to the Constitutional Court regarding the dismissal of Erion Veliaj from the position of mayor are being clarified.

The submissions of the Council of Ministers state that Veliaj's dismissal was based on Article 62, point "c", of the Law on Local Self-Government.

The Council of Ministers states that Veliaj's inability to show up for work is a public fact, the truth of which cannot be questioned.

The Municipal Council has taken decision no. 69, dated 23.9.2025 in the circumstances when the Mayor of Tirana has been physically unable to report to duty since February 10, 2025, due to the imposition of a personal security measure against him.

Despite repeated procedural requests, the court has left in force the measure of imprisonment for the Mayor of Tirana and has not accepted the lifting of the measure, or its replacement with another coercive measure that would enable him to report to duty.

The Tirana Municipal Council has determined that failure to appear for duty, in the above-mentioned circumstances and for a period longer than three months, constitutes legal grounds for proposing the dismissal of the Mayor, based on letter “c”, of article 62, of law no. 139/2015, "On local self-government", as amended.

The legal fact of the inability to appear for duty is a public fact and its truth cannot be questioned./ CNA
