The Minister of Justice, Besfort Lamallari, has requested the High Inspector of Justice (ILD) to launch a disciplinary investigation against the judge of the Korça Court, Eglantina Mikani, for serious procedural violations in the handling of a criminal case against a Russian citizen accused of the crime of "Aid for illegal border crossing", committed in collaboration.

According to the documentation provided by the Ministry of Justice, the criminal decision was announced on December 14, 2022, while the reasoned decision and the relevant file were filed with the judicial secretariat only on March 7, 2024, i.e. with a delay of 14 months and 24 days, in flagrant violation of the deadlines set out in the Code of Criminal Procedure.

Minister Lamallari stated that this unjustified delay has produced concrete legal consequences, as the decision became final on May 20, 2024, depriving the defendant of the opportunity to benefit from the amnesty provided for in Law No. 33/2024.

"In accordance with articles 71/2 of Law No. 115/2016 "On the governing bodies of the justice system", article 6, point 10 of Law 8678/2001 "On the organization and functioning of the Ministry of Justice", as amended, and article 119/2 of Law No. 96/2016, "On the status of judges and prosecutors in the Republic of Albania", the initiation of a disciplinary investigation against the judge of the Court of First Instance of General Jurisdiction of Korça, Eglantina Mikani , is requested," the letter signed by Lamallari states, among other things.

Previously, the Minister of Justice, Besfort Lamallari, has addressed the ILD for a disciplinary investigation against a judge for procedural violations that violate the rights of citizens and the public's trust in justice. We recall that in December, Minister Lamallari requested from the ILD a disciplinary investigation into the judge of Lezha, Ilir Përdeda, who also did not clarify the decision he gave for a year. /CNA
