KPA dismisses Tirana judge's vetting case

The Special Appeals Chamber decided today to suspend the trial of the vetting case of Tirana judge Gentian Hamiti, leaving his confirmation in office in effect.

The decision was made after SPAK head Klodjan Braho withdrew his appeal during the final conclusions on Thursday, considering the judge's explanation regarding the findings in the three reassessment criteria: wealth, purity of image, and professionalism convincing.

The Special Appellate Panel held on 22.01.2026, at 13:00, the public judicial session of the case (JR) no. 21/2024, dated 06.06.2024, which concerns the appeal of the Public Commissioner against the decision of the Independent Qualification Commission no. 743, dated 19.03.2024, relating to the reassessment subject Gentian Hamiti.

The Head of the Special Prosecutor's Office, Mr. Klodjan Braho, stated that the subject of the reassessment, with the new evidence and arguments presented during the judicial process in the College, managed to prove the opposite of the grounds of appeal for all three reassessment criteria. Finally, the Head of the Special Prosecutor's Office requested the College to uphold the decision of the Independent Qualification Commission no. 743, dated 19.03.2024.
The subject of the reassessment, Gentian Hamiti, shared the same position with the Head of the Special Prosecutor's Office, Mr. Klodjan Braho, and requested the College to uphold the decision of the Independent Qualification Commission.

After hearing the final arguments of the parties, the panel decided to close the judicial review and withdrew to make and announce the final decision as follows:

The panel of the Special Appeals Chamber, composed of Ina Rama as presiding judge, Albana Shtylla as rapporteur, Mimoza Tasi, Rezarta Schuetz, Sokol Çomo as members, announced the decision on case no. 21/2024, dated 06.06.2024, which concerns the appeal of the Public Commissioner against the decision of the Independent Qualification Commission, no. 743, dated 19.03.2024, relating to the subject of re-evaluation Gentian Hamiti.

At the end of the trial, the panel, based on Article 4, point 6 of Law No. 84/2016, “On the temporary re-evaluation of judges and prosecutors in the Republic of Albania”, and Articles 451, letter “b” and 463 of the Code of Civil Procedure, unanimously decided:

Discontinuation of the review of case (JR) no. 21/2024, which concerns the appeal of the Public Commissioner against decision no. 743, dated 19.03.2024 of the Independent Qualification Commission, for the re-evaluation subject Gentian Hamiti.

This decision is final and has immediate effect.
