3 million euros in damages with fictitious invoices/ The prosecution uncovers

The Prosecutor's Office at the Court of First Instance in Tirana, in close cooperation with the Directorate of Tax Investigation at the General Directorate of Taxes and with the Local Police Directorate of Tirana, within the Criminal Procedure No. 1054 of 2020, after several months of work with special investigation methods made possible the execution of Decision no. 1981 Reg. Them. dated 24.09.2022 of the Tirana Judicial District Court, which has assigned a security measure of "arrest in prison" to 13 citizens as well as a security measure for some companies.

Siç njofton Prokuroria, nga analizimi dhe studimi i të dhënave të shoqërive objekt hetimi, rezulton se kanë funksionuar si furnizuese, kanë lëshuar fatura fiktive duke mos kryer asnjë blerje dhe duke mos ushtruar në asnjë moment aktivitet ligjor.

Këto fatura fiktive janë injektuar në mënyrë direkte në shoqëri tregtare që operojnë në fusha të ndryshme, në vlerën totale 1,257,082,590 lekë, duke i shkaktuar shtetit një dëm finaciar në TVSH dhe TF, afërsisht 300,000,000 lekë, këto të fundit me kontabilizimin e kësaj vlere kanë ulur pagesën e TVSH mujore, si dhe duke rritur fiktivisht shpenzimet vjetore kanë ulur normën e TF.

“Këto subjekte në bashkëpunim me njëri tjetrin kanë konsumuar elementë të veprës penale “Skemë Mashtrimi në lidhje me Tatimin mbi Vlerën e Shtuar dhe “Bashkëpunimit”, parashikuar nga nenet 144/a dhe 25 e Kodit Penal.

From this criminal activity, citizens through fictitious entities were able to benefit from non-payment of tax obligations and benefiting from them illegally, causing monetary and financial damage to the state in the amount of over 3 million Euros.
