3,000 euros to favor a defendant/ "Prison" for the OPGJ in Dibër

The Special Prosecution Against Corruption and Organized Crime has registered a proceeding for the judicial police officer Sh. C.

OPGJ is being investigated for the criminal offences: "Active corruption of persons exercising public functions", "Passive corruption of persons exercising public functions", "Active corruption of judges, prosecutors and other officials in justice" and "Passive corruption of judges, prosecutors and other justice functionaries", "Abuse of duty" provided by articles 244, 259, 319 and 319/ç, of the Code Criminal.

From the analysis of the investigative actions carried out so far, it appears that:

a. The citizen under investigation Sh.C., in the capacity of the judicial police officer at the Dibër Police Station, asked and received from the citizen under investigation FK, the sum of 3000 thousand euros to favor the procedural position of the citizen A.Sh. in the criminal case against him, [specifically criminal proceeding no. 9/2020 of the Dibër Prosecutor's Office].

b. The citizen under investigation AP, in the capacity of judicial police officer of the Prosecution at the Court of First Instance of the General Jurisdiction Dibër, charged with the investigation of the criminal case in charge of the citizen A.Sh., with his actions and inactions has not regularly fulfilled the legal duty (eg, being aware of the communications with corrupt content, he did not perform any action for referring them to the the relevant prosecutor's office, but acted almost two years later, only when the victim of the criminal offense expressed this fact in the Court, after he was familiar with the acts, he did not refer to any communications of interest and the identification of the persons suspected of committing the corrupt acts even though communications make this fact clear)

At the request of the Special Prosecutor's Office, the Special Court of First Instance for Corruption and Organized Crime with decision no. 156 dated 27.12.2024, decided:

• The appointment of the coercive personal security measure "prison arrest" against the citizen under investigation Sh.C., the son of Miftar and Zyrake, born on 28.03.1960, born and resident in Dibër, provided for by article 238 of the Criminal Code . Criminal, as a suspect for the criminal offense "Passive corruption of judges, prosecutors and other officials of justice bodies", provided by article 319/ç of the Criminal Code.

• The assignment of the coercive personal security measure "Compulsion to appear before the judicial police" against the citizen under investigation AP, the son of Kadri and Vjollca, born on 11.05.1980, born and resident in Dibër, provided by article 234 of the K. Criminal Prosecution, as a suspect for the criminal offense "Abuse of duty", provided for by Article 248 of the Criminal Code.

• The appointment of the personal security measure "Compulsion to appear before the judicial police" against the citizen under investigation FK, the son of Qazim and Sadete, born on 21.02.1962, born in Dibër, Staravec village and resident in Tirana at the address: Rruga "Selaudin Zorba", private residence, provided by article 234 of the Penal Code, as a suspect for the criminal offense "Active corruption of judges, prosecutors and other officials in justice", provided by article 319 of the Criminal Code. (this measure has not yet been implemented).

The other measures were executed on 28.12.2024, by the judicial police services of the General Directorate of the State Police, which we take the opportunity to thank for their cooperation.
