Dismissal of former prosecutor/ Strasbourg Court overturns vetting decision

The Strasbourg Court has overturned the dismissal of former prosecutor Ferdinand Elezi from the vetting process. The decision of the European Court of Human Rights states that a violation of Article 8 of the European Convention on Human Rights has been found.

Elezi, who had held the position since 1999 and most recently headed the prosecution office at the Court of Appeal in Durrës, was dismissed in 2020 by the Special Appeals Chamber due to problems found in the valuation of assets.

The Strasbourg court found that the Albanian authorities had not found any problems with the legal origin or declaration of the main assets of the prosecutor's family. According to the decision, his dismissal was not a necessary measure in a democratic society and that the Albanian authorities had failed to prove the proportionality of their decision.

For this reason, the ECtHR concluded that the dismissal of the prosecutor was disproportionate to the legitimate aims of the vetting process and constituted a violation of the right to respect for private life.

The Strasbourg decision states that as compensation, the Albanian state has been ordered to pay Elezit 6,000 euros in moral damages and 5,000 euros for legal costs. This Strasbourg decision paves the way for Elezit to return to the justice system.

On April 9, 2019, the Independent Qualification Commission decided to dismiss him from office, the decision being upheld by the Special Appeals Chamber on September 30, 2020. /CNA
