Ethical and professional evaluation of prosecutors/ KLP approves changes to

The High Prosecutorial Council (HPC) has approved a decision on several changes to the regulation on the ethical and professional evaluation of prosecutors.

Regulation:

For a 3-year period

Prosecutors who participate in up to 5 days of training will receive 5 points. For participation from 6 to 15 days, 1.5 points will be awarded for each day, but not more than 20 points. For participation over 120 days, 1.5 points will be deducted for each day.

For a 5-year period

For participation up to 5 days of training, 5 points will be awarded. For participation from 6 to 30 days, 0.66 points will be awarded for each day. Participation over 200 days will result in a deduction of 0.66 points for each day.

There are also changes in the score for participation in inter-institutional activities and public relations. All prosecutors will be assessed with 5 points for this indicator, as participation in these activities does not always depend on their will. However, those who are assigned to participate and do not do so without objective reasons will be assessed with 0 points.

As a bonus, prosecutors who participate in these activities simultaneously with their judicial work will benefit from 2 additional days in the calculation of training points.

Decision:

"ON THE APPROVAL OF THE REGULATION "ON THE DEVELOPMENT OF PROCEDURES FOR THE RE-ASSESSMENT OF SUBJECTS BY THE HIGH JUDICIAL COUNCIL AND THE HIGH PROSECUTOR'S COUNCIL"

 Based on Articles 149, point 1, 149/a, point 1, letter "e", 179/b and the Annex "Transitional Re-evaluation of Judges and Prosecutors", of the Constitution of the Republic of Albania, in Law No. 84/2016 "On the Transitional Re-evaluation of Judges and Prosecutors", in Law No. 44/2015, 'Code of Administrative Procedures of the Republic of Albania", in Law no. 115/2016 “On the governing bodies of the justice system”, as amended, in Law no. 96/2016 “On the status of judges and prosecutors in the Republic of Albania”, as amended, upon the proposal of the Working Group under Order no. 195, dated 16.12.2024, “On the preparation and drafting of the action plan for the unfinished issues of the re-evaluation of prosecutors by the Independent Qualification Commission”, of the President, High Prosecutorial Council.

2. DECIDED: The approval of the Regulation "On the development of procedures for the re-evaluation of subjects by the High Judicial Council and the High Prosecutorial Council", according to the attached text.

This decision enters into force on the date of publication in the Official Gazette and is published on the official website of the High Prosecutorial Council. /CNA
