Constitutional Court dismisses Assembly over Rules of Procedure: The principle

The Constitutional Court has published the full decision regarding the changes to the Assembly's regulations, giving the latter a 30-day deadline to reflect and implement the decision.

The decision essentially overturns the procedure followed to establish 11 permanent parliamentary committees, approved in September of last year. According to the Court, the process was irregular and violated the rights of the opposition.

The Court assesses that the parliamentary minority members have been restricted in their ability to fully participate in decision-making, particularly due to the manner in which the plenary session was convened and the use of the accelerated procedure for approving amendments.

In its reasoning, the Court emphasizes that these actions have violated the principle of representative democracy and the freedom of expression of the opposition in the Assembly.

"The court assessed that the annulment of the Assembly's decision should be decided due to the violation of the principle of representative democracy related to the freedom of expression of deputies as a result of the violation of the rules for calling the Assembly meeting as well as the procedure followed for the approval of the act under review," the court's decision states.

However, to avoid an institutional vacuum, the effects of the decision will enter into force 30 days after publication in the Official Gazette, allowing the Assembly time to reorganize the committees in accordance with constitutional standards.
