Argita Malltezi today, in a press conference, dismissed, according to her, SPAK's claims about the "Partizani" file.

Malltezi stated that the SPAK has no evidence against Berisha and the basis for the continuation of the arrest measure for Berisha is the existence of a risk of escape or destruction of evidence.

Malltezi said that SPAK continues with the argument that Berisha is a former prime minister, former president and deputy and can spoil the evidence.

The daughter of the leader of the DP, Argita Malltezi, has accused that SPAK is not prolonging the investigations, but the frauds and concealment of documents.

"The other basis for which the continuation of the arrest measure for Berisha is requested is the existence of a risk of escape.

In fact, in the parliament, SPAK said that the measure against Berisha is being decided because he did not respect the first measures. Then, by political order, the dance was changed and SPAK raises this claim. There is no evidence for this. SPAK says that there is a risk of running away because they have the financial means. That is the argument of SPAK.

SPAK says that the measures should be extended because the investigations are complex, but in fact the only things that are prolonged are frauds and hiding of documents by SPAK. You heard Duman say that a property investigation is being conducted for Berisha. But the property investigation for Berisha started on day 1 of the criminal registration.

If on April 9, 2022, Edi Rama threatened SPAK that if he did not investigate Berisha, he would say that the reform has failed, and then SPAK issued a cartoon of investigative actions.

But in the file there are a lot of documents related to requests that were made to HISSH, ASHK, banks and other institutions. So it is not true that Berisha is being held under investigation because the property investigation against Berisha has now started. No, the property investigation against Berisha started four years ago.

As to why Duman is lying, that is his business. But one should not forget that public statements are related to one's integrity as a person in the first place, then to one's quality as a jurist. A man who lies in public has no problem breaking the law in any form.

A man who imprisons an innocent man has no problem at all in releasing a criminal. It is a much lesser crime to release a criminal from prison than to keep an innocent man in custody without evidence. SPAK has said that the arrest should continue because there is a risk of spoiling the evidence.

Apart from the fact that there is no evidence, no mention of Berisha, the only argument offered by SPAK and which the court has repeated in other decisions it has made before is that this is the pearl, they are all in unison in their findings : Berisha is a former prime minister, former president and currently a member of parliament and has the opportunity to tamper with evidence and influence witnesses.

So, having been a figure from the highest of the state hierarchy, was a reason to put you under arrest. It is a reason to put you under arrest, when the arrest is political. 

They do not say that this proof or that proof exists. The court must say which evidence Berisha tried to destroy. Nothing is said about Malltez, he remains in prison as an extra. Absolutely no argument for Malltez.

It is said about Berisha that he is a member of parliament and can tamper with evidence. I mean I am deciding a measure that the other is an opposition deputy. Isn't this the perfect definition of a political prisoner according to the Council of Europe resolution of 2012? When someone is imprisoned in violation of the fundamental guarantees of the Convention, for purely political reasons and unrelated to a criminal offense, in a discriminatory manner.
