Special Appeal: Veliaj, Ajola Xoxa and Elman Abule, as a structured criminal

CNA has secured the Special Appeal decision dated March 13, 2025, taken by Judge Engert Pëllumbi.

Judge Engert Pëllumbi has exceeded the requests of SPAK, where based on the facts and evidence collected for Mayor Erion Veliaj, his wife Ajola Xoxa and businessman Elman Abule, he notes that the cooperation between these persons under investigation has the characteristics of a special cooperation, that of a structured criminal group.

"In this context, the court notes that the cooperation of the persons under investigation Erion Veliaj, Ajola Xoxa and Elman Abule has the characteristics of a special cooperation, that of a structured criminal group, regulated by Article 2874 of the Criminal Code, given that the criteria of plurality of persons (three persons), the commission of criminal activity for the purpose of material gain (laundering the proceeds of the criminal offense of corruption) and the non-creation of the group by chance (the commission of criminal activity repeatedly and over a long period of time) are met, despite the fact that such a form of cooperation has not yet been attributed to these persons under investigation and, consequently, will not be taken into consideration at this time by the court in determining the type of security measure, since otherwise the principle of non-aggravation of the defendant's position non reformatio in peius would be violated," the Special Appeal decision states.

Also, in the Appeals Decision of the GJKKO, all denigrating, insulting and threatening writings against prosecutors and judges have been exposed.

Thus, Judge Engert Pëllumbi goes beyond the request of SPAK prosecutors for wiretapping, going so far as to consider the collaboration between Veliaj, Xoxa and Abula as characteristic of a structured criminal group./ CNA
