Scandal at the Magistrates' School/ Arben Rakipi announces zero criteria

Journalist Flavio Qarri has shared a denunciation of a scandal at the Magistrates' School, headed by Arben Rakipi, on his social networks.

According to the complaint, the School of Magistrates has set criteria for judges and prosecutors that are not published in the Center for Official Publications, are not based on law and are based only on internal regulations.

The regulation is not even published in the QBZ, which makes this act and regulation legally null and void.

According to the complaint, Arben Rakipi is using the criteria to disqualify candidates and is not being elaborated on by the justice authorities, although they are aware of it.

"Hello, I congratulate you for your professionalism and the real issues you address.

I am conveying to you information that would shake a legal state if one existed.

The School of Magistrates is in violation of the Constitution, article 136/a point 2 and article 148/ç point 2 (*Where it is stated that the criteria for judges and prosecutors are determined by law)

It has set criteria without law based on the Internal Regulation, which is a null act (without legal force) since it is not published with the QBZ, the Center for Official Publications, where acts with legal force are published.

In violation of the Constitution, the Magistrates' School, not only has not published the Internal Regulations in the Official Gazette (QBZ), but in violation of every legal norm, it uses this act (the Internal Regulations, which from a legal perspective, as long as they are not published in the QBZ, have no legal force), the Magistrates' School uses this 'Improper Regulation' and thereby qualifies or disqualifies candidates for judges and prosecutors who compete.

Simply put, Arben Rakipi's School of Magistracy justifies the qualification and disqualification of candidates for judges and prosecutors in an act without legal value.

This data would constitute an abuse of duty for any head of a justice institution to justify the qualification/disqualification of a candidate based on an act not published in the QBZ. But this scandal, although it circulates in justice circles, they do not have the courage to elaborate on it since such a procedure is a mega-scandal.

To prove this scandal, a simple letter or email to the QBZ (the Official Publications Center, which is a public body under the Ministry of Justice, which publishes every act from the Constitution to a simpler act) is enough. Where to ask if:

"Does the "Internal Regulations" of the Magistrates' School turn out to be published?! And they will answer that it is not published in the QBZ, (therefore it has no legal force) but A.
