Fraud involving hundreds of thousands of euros/ The former employee of the

The Court of Appeal has sentenced the former employee of the Assembly, Milena Deraj, to 5 years in prison.

Deraj is accused of taking the amount of 340,000 euros from some people, promising help to win a court case.

The former employee of the Parliament and the Bank of Albania has also deceived one of her friends, taking the amount of 230 thousand euros with the promise to invest in treasury bonds.

NOTICE

Referring to previous reports in the media, the Court of Appeal of General Jurisdiction informs the following:

The Prosecutor's Office at the Court of First Instance of General Jurisdiction, on the basis of the incriminating materials of 2023, has registered criminal proceedings for the criminal offense of "Fraud", against the defendant with the initials M. D, a former employee of the Bank of Albania, with economist profession. The defendant benefited from the sum of 340,000 Euros, deceiving the citizen with the initials A. D, etc., by taking over the resolution of the court case against some defendants. Likewise, her friend with the initials E. Sh, received the sum of 250,000 Euros, promising that she would invest this money in treasury bonds.

In the Court of First Instance of the General Jurisdiction of Tirana, the trial was held against the defendant with the initials M. D, accused of committing the criminal offense of "Fraud" with serious consequences, provided for by Article 143/3 of the Criminal Code.

The Court of First Instance of Tirana General Jurisdiction, with decision no. 1088, dated 30.04.2023 decided:

1. The guilty declaration of the defendant M. D, for committing the criminal offense of "Fraud" with serious consequences, provided for by Article 143/3 of the Criminal Code and based on this provision her sentence of 7 (seven) years and 6 (six) months imprisonment.

2. In application of Article 406 of the Penal Code, 1/3 of the punishment is reduced and ultimately the defendant M. D. is sentenced to 5 (five) years of imprisonment.

3. The serving of the sentence will start from the day of detention, dated 25.05.2023. The remainder of the sentence will be served in a regular security prison.

The case in Appeal was examined on the basis of the complaint made by the defendant with the initials M. D, who requested:

1. Changing the decision of the Court of First Instance of General Jurisdiction Tirana.

2. Declaration of the defendant's innocence.

3. In case the court finds him guilty, we request:

- The guilty declaration of the defendant, for the criminal offense of "Fraud", provided by article 143/3 of the Criminal Code and her sentence of 5 (five) years of imprisonment.

- In application of Article 406 of the Penal Code, 1/3 of the sentence is reduced, finally sentencing him to 3 (three) years and 4 (four) months of imprisonment.

- The application of Article 59 of the Criminal Code, the suspension of the execution of the prison sentence and the probation of the defendant. 

At the end of the trial, today on 13.06.2024, the Court of Appeal of General Jurisdiction, the panel with Judge Relator Mr. Fatri Islamaj and member Mrs. Edlira Petri and Mrs. Marsela Pepi decided:
