The head of the Democratic Party Parliamentary Group, Gazment Bardhi, in a post on social media yesterday emphasized that we should decriminalize defamation and insult, making these administrative offenses.

" European standards on freedom of expression and OSCE-ODIHR reports require Albania to decriminalize the criminal offenses of insult and defamation, considering them only civil violations. This measure is important for guaranteeing freedom of expression, especially for the media and civil society activists ," writes Gazment Bardhi.

 

That Gazment Bardhi is a legal idiot, as a politician perhaps worth less than his legal idiocy, this does not need to be repeated. Perhaps because he graduated from the Faculty of Law with an average of 5 or less, he comes up with such nonsense that once again shows the alarming level of ignorance and lack of legal culture not only from Gazment Bardhi, but also more broadly in the DP Parliamentary Group.

For Gazi and every stupid politician in the field of jurisprudence to learn, the decriminalization of defamation and insult was done by the Berisha government in 2012.

 

What is decriminalization?

Decriminalization is an offense provided for in the Criminal Code, which does not provide for imprisonment. So it is purely administrative as Gazment Bardhi says and it was done 14 years ago. What Gazi, who studied Law with a friend, probably wanted to say is decriminalization.

 

What does decriminalization mean?

Decriminalization, so that Gazi can learn, means that it is not a criminal offense, which exists in the Criminal Code.

Decriminalization did not occur either in Sali Berisha's government, which decriminalized it, or in the amendments approved yesterday by Parliament, where the article in the Code was not repealed, but simply several paragraphs were added to Article 120.
