Reopening of investigations into Veliaj/Activists request for proceedings

Activists Aurel Kujtimi and Andrea Bregu have filed a request with the High Prosecutorial Council and the High Inspector of Justice to launch a disciplinary investigation against prosecutor Bledar Valikaj, accusing him of violating the law and failing to implement a court decision.

The focus of the request is the issue of reopening the investigations into Erion Veliaj and Anila Shehu, a decision taken on October 31, 2024 by the First Instance Court of General Jurisdiction in Tirana.

The court tasked prosecutor Valikaj with conducting investigative actions, including questioning the administrator of the entity that carried out the works and the inspector and supervisor of the reconstruction of the student buildings in Student City.

The decision was also upheld by the Court of Appeal on May 13, 2025 and became final on September 22, 2025. According to activists, the prosecutor did not carry out his duties within the legal two-month deadline.

We have just sent by mail the request addressed to the High Council of the Prosecutor's Office and the High Inspector of Justice for the initiation of disciplinary proceedings against Prosecutor Mr. Bledar Valikaj for violating the law and the Decision of the First Instance Court of General Jurisdiction of Tirana (Criminal Chamber) with Judge Ms. Vjollca Spahiu.
On 31.10.2024, the Court of First Instance of General Jurisdiction of Tirana (Criminal Chamber) decided to reopen the investigations for Anila Shehu and Erion Veliaj, assigning the prosecutor of the case, Mr. Bledar Valikaj, two tasks:
1. To question the administrator of the entity that carried out the works and the equipment of the student rooms regarding the manner in which the works were carried out and what manual they relied on regarding the equipment of the rooms with the relevant furniture.
2. To question the inspector and the supervisor of the works regarding the tasks ordered by the prosecutor in the preliminary investigation phase, but not effectively carried out.
In the decision of the Court of First Instance of General Jurisdiction of Tirana (Criminal Chamber), a two-month deadline was set for the performance of the above-mentioned tasks. Prosecutor Mr. Bledar Valikaj appealed the court's decision to the Tirana District Court of Appeal, the hearing at the Tirana District Court of Appeal was held in the Deliberation Chamber on 13.05.2025 and the Court of Appeal with Judge Ms. Marsela Pepi decided to dismiss the request of prosecutor Mr. Bledar Valikaj and to uphold the decision of the First Instance Court of General Jurisdiction of Tirana (Criminal Chamber).
The decision became final on 22.09.2025 and Prosecutor Mr. Bledar Valikaj did not appeal the decision to the High Court.
From 23.09.2025 to 23.12.2025, Prosecutor Mr. Bledar Valikaj had a legal deadline to perform the duties set by the First Instance Court of General Jurisdiction of Tirana (Criminal Chamber). Previously, information on the continuation of the case and the stage of the investigation was requested through a request for information dated 05.12.2025 and no information has been provided by the prosecutor to date.
For more than 3 months now, the Prosecutor Mr. Bledar Valikaj has been in violation of the law and the court's decision and has not made any notification of the extension of the investigation or notification to the parties about their extension.
For this fact, in the capacity of the complainant, today a request has been sent according to the law, addressed to the KLP and the ILD with the aim of taking disciplinary measures against the Prosecutor Mr. Bledar Valikaj, acting Prosecutor at the Tirana Judicial District Prosecutor's Office, for violating the law and the court's decision.
Tomorrow we will also address the First Instance Court of General Jurisdiction of Tirana (Criminal Chamber) with a request according to the law, for the verification of the court's decision and taking procedural measures to send the case to court.
