The High Inspector of Justice has completed the disciplinary investigation against the magistrate of B.SH, initiated based on continuous complaints to the ILD from the chancellor, since the magistrate in the position of vice-president of the Administrative Court of the First Instance of Vlora, prevented him from exercising legal duties, not allowing the normal functioning of the court.

From the disciplinary investigation conducted by the High Inspector of Justice, it is proven that:

Magjistrati B.SH. ka lejuar moszbatimin, pa shkaqe të justifikuara, të vendimit të dhënë nga Këshilli i Lartë Gjyqësor lidhur me kancelaren e gjykatës, si dhe në mënyrë të përsëritur, gjatë dy mbledhjeve të Këshillit të Gjykatës, nuk ka respektuar dispozitat ligjore dhe nënligjore, që rregullojnë organizimin dhe funksionimin e gjykatave
Ndërmarrja e këtyre veprimeve nga magjistratit përbëjnë mospërmbushje të detyrës së zvkryetarit, i cili ka përgjegjësi për mbarëvajtjen dhe funksionimin e gjykatës si institucion, dhe ka krijuar konfuzion mbi ushtrimin e kompetencave të kancelares, e cila është përgjegjës për menaxhimin e administrimit gjyqësor.
Shkeljet e konstatuara nuk lidhen me veprimtarinë e tij profesionale të magjistratit. Ato mund të jenë të rëndësishme për vlerësimin etik dhe profesional të tij, por janë të natyrës që magjistrati duhet të mbajë përgjegjësi disiplinore.
Moszbatimi pa shkaqe të arsyeshme nga ana e tij si drejtues i një vendimi të dhënë nga Këshilli i Lartë Gjyqësor vlerësohet si një sjellje joprofesionale, e cila diskrediton pozitën e drejtuesit të një gjykate dhe figurën e gjyqtarit në veçanti.
Në përfundim të hetimit, ILD duke mbajtur në konsideratë mes të tjerash, natyrën e shkeljes disiplinore, ekzistencën e rrethanës lehtësuese, e lidhur me shkeljet për herë të parë; bashkëpunimin e magjistratit gjatë hetimit; si dhe ndihmën në mënyrë aktive për të zhdukur ose pakësuar pasojat e shkeljes; arrin në konkluzionin se veprimet/mosveprimet e ndërmarra nga ana e zvkryetarit të Gjykatës Administrative të Shkallës së Parë B.SH., përbëjnë shkelje disiplinore të parashikuar nga nenin 102 pika 1 shkronjat “g” dhe “gj” të ligjit nr. 96/2016 “Për statusin e gjyqtarëve dhe të prokurorëve në Republikën e Shqipërisë”, të ndryshuar; si “Shkelje disiplinore e lehtë”.

For the above, the High Inspector of Justice requests the Supreme Court of Justice to accept the request for the initiation of disciplinary proceedings against judge B.SH., for disciplinary violations provided for by article 102, point 1 letters "g" and "gj" of law no. 96/2016 "On the status of judges and prosecutors in the Republic of Albania", amended, and the appointment of the disciplinary measure "Public notice"

"Public notice" fulfills two preventive purposes: special prevention, in the sense that the magistrate will not commit disciplinary violations in the future; and general prevention, in the sense that other magistrates understand that inappropriate behavior should not be carried out, as it is punishable by disciplinary measures./ CNA.al
